The Supreme Court on Thursday issued notice to the Centre, the West Bengal government, and the Election Commission on a plea seeking SIT investigation into the causes of post-poll violence in West Bengal.
The Plea also sought direction to the Centre to impose President’s Rule in West Bengal in view of deteriorating law and order situation due to the post-poll violence which started on May 2, the day of assembly election results.
Advocate Hari Shankar Jain— appearing for petitioners Ranjana Agnihotri, a UP-based practicing lawyer and social worker Jitender Singh— said that the plea is against post-poll violence in West Bengal.
The court said, “We are issuing notice to Union of India, West Bengal government and Election Commission of India.”
The court, however, did not issue notice to respondent number 4— Mamata Banerjee as the president of Trinamool Congress Party (TMC).
The petition has been filed through Advocate Vishnu Shankar Jain stated that thousands of residents of West Bengal are being terrorized, penalized, and tortured by the workers of Trinamool Congress (TMC) for supporting the o political party Bhatiya Janta Party (BJP) during General Elections of the State Assembly held in April 2021 of which result was declared on 2 May.
The Petitioners are espousing the cause of thousands of citizens of West Bengal who are mostly Hindus and are being targeted by Muslims to take revenge for supporting BJP as they want to crush Hindus so that for years to come the power may remain with the party of their choice, the plea said.
The petitioner claimed that soon after the declaration of result on 2nd May the TMC workers and supporters started creating chaos, unrest and set the houses and properties of Hindus on fire, looted and plundered their belongings for the simple reason that they had supported BJP. In course of creating an atmosphere of terror and disorder in the society, atleast 15 BJP workers/sympathizers/supporters were allegedly murdered and several persons were seriously injured. The women were abducted and raped, the plea added.
The Petitioner alleged that the Government Officials, the Administration, and the Police are supporting those political workers of TMC, due to which the life, liberty, prestige, dignity, and modesty of women are being taken away as is evident from the fact that many persons have been harmed, butchered, mercilessly murdered, and the girls and women have been raped and no steps have been taken for their safety. No appropriate action has been taken against the culprits, due to which the life, liberty, dignity of the women and children are in peril and the future of Hindu residents is in jeopardy, it said.
A section of Muslims is humiliating Hindus after the victory of TMC in the election. Celebrating victory is part of democracy and that occurs after the result of the election but creating an atmosphere of terror, turmoil, fear, unrest, and intention to suppress Hindus are very serious and sensitive matter and the Government of India must take action following the provisions of the Constitution, but unfortunately, the Government of India only observed the ritual of summoning report in the matter without any follow-up action, due to which thousands of men and women are weeping and are in the lurch of their good days of destiny, the plea added.
