SC to hear slew of petitions seeking to criminalize marital rape on 9 May

The Supreme Court set 9 May for a detailed hearing on a slew of petitions seeking to criminalize marital rape. Indira Jaising, a senior advocate, raised the issue before a bench led by Chief Justice DY Chandrachud.

She informed the bench that the order of arguments and the common compilation in the case are complete. According to Solicitor General Tushar Mehta, the Centre’s response is ready but needs to be vetted.

The Apex court on 16 January had sought a response of the Centre on a batch of petitions pertaining to criminalization of Marital rape. The bench said that “List this on May 9, 2023.”

One of the petitions was filed in response to the Delhi High Court’s split decision on the issue. Khushboo Saifi, one of the petitioners before the Delhi High Court, filed this appeal,  on May 11, last year, the Delhi High Court issued a split decision on the issue.
