The Supreme Court, led by a five-judge Constitution bench including Chief Justice of India DY Chandrachud, upheld the government’s decision and dismissed challenges against the abrogation. Chief Justice Chandrachud underscored that every decision made by the Centre on behalf of a State under proclamation couldn’t be legally challenged to avoid administrative standstills.
The Court emphasized Article 370 as a temporary provision, meant for Jammu and Kashmir’s integration, not disintegration, noting that the President could declare its cessation. Additionally, it directed the Election Commission to conduct Jammu and Kashmir Assembly elections by September 30, 2024, while urging the expeditious restoration of the region’s statehood.
The ruling party’s accolades for the Supreme Court’s validation reiterate the government’s commitment to Jammu, Kashmir, and Ladakh’s comprehensive development following the transformative Article 370 abrogation on August 5, 2019.
