The Surat Session Court granted bail to Rahul Gandhi till the disposal of his appeal in the case filed against him for defamation over his remark, why all thieves share the Modi surname made by him during a political campaign in Karol in April 2019.
The court has not yet stayed the Conviction of Rahul Gandhi, the court issued the notice to the complainant (Purnesh Modi) on the plea filed by Gandhi for a stay on his conviction. Therefore, the court stated that the complainant has been asked to file its reply by April 10, 2023.
Further, an appeal was made by the Congress leader Rahul Gandhi in the Surat Sessions Court wherein challenging the conviction of Rahul Gandhi. Thus, the said appeal has been accompanied by two applications, firstly, being the application for Suspension of Sentence, which is essentially an application for regular bail, and secondly, the application for Suspension of Conviction.
However, if the second application is allowed by the court, the membership of Rahul Gandhi of the Lok Sabha will be restored and which being subject to the issuance of notification of the LS Secretariat with this regard.
Further, the court recalled that the Chief Judicial Magistrate sentenced Rahul Gandhi to two years in jail on March 23, following which Rahul Gandhi was being disqualified as MP of Lok Sabha. However, the court suspended the sentence of Rahul Gandhi the court has also granted bail for enabling him to move an appeal against his conviction within 30 days.
Accordingly, the court listed the matter to be next heard on April 10.
