The Gujarat’s Surat District convicted the Congress leader and MP Rahul Gandhi in a defamation case for his remarks “why all thieves share the surname of Modi” being made during a campaign in Karol in April 2019.
However, the Court of Chief Judicial Magistrate HH Varma sentenced him to two years in jail and the court has also imposed a fine for an amount of Rs. 15,000 after the court finds him guilty under Section 499 (Defamation) Section 500 (punishment for Defamation) of Indian Penal Code, 1860. In this case, he also secured a bail.
Therefore, the court also suspended the sentence of Rahul Gandhi’s in a plea filed by him and has also granted bail for enabling him to move an appeal against his conviction within 30 days.
Facts of the Case:
The complaint has been filed by the BJP MLA and former Gujarat minister Purnesh Modi Purnesh Modi under Section 499 and Section 500 of the Indian Penal Code, 1860 against Rahul Gandhi for his alleged remarks wherein stating that it has defamed all people with the ‘Modi’ surname while addressing a rally at Kolar in Karnataka ahead of the 2019 Lok Sabha elections.
Therefore, the remarks had been video graphed by the video surveillance team and the video viewing team duly notified by the office of Deputy Commissioner and the District Election Officer, Kollar District.
The Gujarat High Court in the case observed and has vacated the stay on trial in the case of criminal defamation in February this year. However, Rahul Gandhi remained present in the court when the verdict was pronounced by the court. Earlier, on three occasions too, he was being presented before the court.
It has also been maintained by the Gandhi that there being no malafide intention on his part when he made the statement in question.
