The Supreme Court of India in the case Jahidul Islam @ Md. Jahidul Islam Vs The State Of Assam observed and has asked the State of Assam for filing the counter affidavit in a plea moved by a third-year law student seeking bail, in a case registered under the Narcotic Drugs and Psychotropic Substances Act, 1985, NDPS.
The bench comprising of Justice Ajay Rastogi and Justice Bela Trivedi in the case wherein the SLP was filed challenging an order of the Guahati High Court dated November 15, last year, while denying the anticipatory bail to him.
The court in the case observed that as per the prosecution on 22.09.2022, the team of police searched the house of the petitioner and it has recovered 9.80 gm of suspected heroine in the four plastic containers, one being the tobacco containers with 21.89 gm of suspected heroine and 24 capsules of the Span-Trancan Plus.
The counsel appearing for the state submitted before the court that the State vehemently opposed the SLP. It has been argued by the counsel that since the petitioner being the law student, the petitioner should not have restored to such activities. Thus, someone who being the law student should have known better.
Therefore, when the said bench asked him the age of the petitioner, of which the advocate that he would be 25 years, at max.
Further, it has been argued by him that there being a huge war going on in Assam against drugs.
The court in the case observed and has stated the order of High Court dismissing the pre-arrest bail in the month of February.
Accordingly, the court issued the notice.
