The Supreme Court advocates-on-Record Association has alleged that ordinary matters are being listed for hearing during the ongoing summer vacation.
The bench of Chief Justice DY Chandrachud, SCAORA in its circular issued stated that several matters are being listed including single judge matters during the present ongoing summer vacations in complete violation of the circular as ordinary matters are being listed by the registry which cannot be listed during the ongoing summer vacations. Therefore, the same is caused great hardship to members of the bar who are not present in Delhi and are not carrying the files.
It has also been requested by the lawyers’ association that the chief justice to direct the Supreme Court registry to follow the said circular and list only those matters which are allowed as per the scheme given. The Supreme Court issued the circular on May 22 wherein it is categorially stated that only those matters which have been notified would be allowed to be mentioned for urgent listing during this summer break. Further, the list includes matters in which the death penalty has been awarded, petitions for a writ of habeas corpus and related matters, the pleas for anticipatory bail and against orders refusing or granting bail, etc.
