The Supreme Court in the case observed and has refused to entertain the Public Interest Litigation, PIL moved seeking directions to State Governments to set up ‘Courts Special Cells’ to ensure compliance with Court Orders.

The bench headed by CJI in the case observed and has rebuked the petitioner, you are back again? Last time I told you not to file such PILs…somebody will impose costs of on you. Now the said direction in PIL that all state govt and must comply with the court orders… we were gentle on you last time, but you have persisted on filing these PILs. Please do something else. If you have a little free time, you can attach yourself to a Senior Lawyer, learn some law and not file these kinds of petitions’

In the present case, the Public Interest Litigation, PIL moved seek directions to the state governments to constitute ‘ Courts Special Cells’ overseeing compliance of orders passed by the Courts and to issue circulars to the government departments to follow the orders of the Court.

The bench headed by CJI explained that the Court need not pass any such specific directions as the remedy already lies in filing a contempt petition in a situation when the state authorities do not follow the orders of the Court.

Further, it has been stated by him that this court cannot pass a general order like this. That is the law, you have to comply with the orders passed by the Court.
The court while considering the facts and circumstances of the case finds the PIL to be ‘misconceived’.
Accordingly, the court dismissed the PIL.
