An application is moved in the Supreme Court wherein seeking to stop the rallies proposed to be carried out by the Vishwa Hindu Parishad and Bajrang Dal in Delhi-NCR region in the wake of the communal clashes between Nuh and Gurugram.
The present plea is moved by an Interlocutory Application, IA which being the pending writ petition concerning hate speeches.
The application as mentioned by Senior Advocate Chander Uday Singh for urgent listing.
The bench comprising of Justice Aniruddha Bose was hearing the present plea as the Chief Justice of India and the next four senior judges are sitting in the Constitution Bench for hearing the Article 370 case.
The counsel, Senior Advocate Chander Uday Singh informed the court that twenty-seven marches have been announced by VHP-Bajrang Dal in the happenings in Nuh. However, the bench of Justice Bose expressed doubts with regards to whether he has the authority to entertain the mentioning for the listing of the IA and asked Singh to get a confirmation regarding this.
Therefore, Senior Advocate Chander Uday Singh approached the bench of CJI which was about to start the hearing in the Constitution Bench matter.
It has been submitted by the Singh before the court that I am really sorry to do this. Thus, the clarification is needed is needed on whether Hon’ble Justice Bose’s bench can hear mentioning, this being something very urgent. Adding to it, CJI replied that there being the provision in the latest SoP, circulate an email. Thus, the once the mentioning is not available or mentioning is over, the email will be put up by the Registrar, Listing and this court pass an immediate order of listing.
It has also been informed by the CJI to Singh that every mentioning request made till late night 9 PM was attended and I was little liberal since I knew this was going to happen as the first five judges are in the Constitution Bench. Therefore, all request in the case have been granted and if there is something over and above that, the SoP has a provision. Following which, the date will be given immediately.
Accordingly, Singh stated that I will send of the email immediately and there being something very dire.
