The Supreme Court in the case observed and has issued a notice on the plea moved by top woman wrestlers of the country, wherein seeking registration of the FIR against BJP MP and Wrestling Federation of India, WFI president Brij Bhushan Sharan Singh over the alleged sexual harassment.
The bench comprising of Chief Justice of India DY Chandrachud was hearing the present matter.
The bench of CJI DY Chandrachud in the case observed and has pointed out that normally, a remedy of being approaching to the Police Superintendent is available under Section 156 of Code of Criminal Procedure. What being the charges?
It has been submitted by Sibal before the court that these women being the wrestlers Milord and they are sitting in the dharna. Thus, it has been complained by the 7 woman in which one being minor, wherein violating the law of the said court.
It has also been alleged by the petitioner in the plea that there has been inordinate delay in registering FIR, especially when POCSO charges are pressed against the wrestling body’s president. Thus, the allegations made reportedly date back to 2012. The petitioners in the case have been protesting against such inaction at the Delhi’s Jantar Mantar.
The court in its order stated that there being a serious allegation at the behest of professional wrestlers concerning sexual harassment. The court issued the notice which is returnable on Friday. Further, the bench of CJI directed that the complaints which were being given in sealed cover shall again be resealed and to be places under the plea filed.
It has also been claimed by Sibal in the case that there being a committee report which has not been made public. Thus, even the police persons can be prosecuted for not registering of an offence of the said nature. Now there being only an amendment to Section 166A of Code of Criminal Procedure, wherein it allows the police to also be prosecuted if the case is not registered.
Meanwhile, in the case, the Sports Ministry seeks a response from WFI in terms of the National Sports Development Code, 2011
Accordingly, the court listed the matter to be next heard on May 28, 2023.
