The Supreme Court in the case The State of Rajasthan vs Saifurrehman Ansari observed wherein Supreme Court judge Justice Sandeep Mehta has recused from hearing the appeal filed by the State of Rajasthan against the acquittal of accused persons in the Jaipur bomb blasts case in 2008.
The bench of Justice B.R. Gavai was also a part of the division bench composition.
In the present case, on May 13, 2008, several explosions took place in Jaipur which resulted in the death of 71 persons and injuries to 185 persons. Thus, the trial court found four persons guilty of the offence and awarded them the death penalty.
Last year, in March, the Rajasthan High Court set aside the convictions, after pointing out glaring lapses in the investigation.
The court in the case observed and has also declared that one of the accused persons was a juvenile at the time of the offence.
Therefore, the State and victim filed separate appeals against the victims against the acquittal judgment before the Top Court.
The court in the case observed and has refused to pass an absolute stay on the order of the High Court while hearing the State’s appeal on May 17, 2023.
The Apex Court in the case observed and has ordered their release subject to certain conditions. The Supreme Court in the case dismissed a Special Leave Petition filed by the State of Rajasthan against its High Court’s order wherein declaring one of the convicts in the case to be a Juvenile on the date of occurrence on December 08, 2023.
However, Rajasthan High Court is the parent High Court of Justice Mehta, who was elevated to the Supreme Court in November last year.
