Supreme Court Granted Leave In Nagaland’s Petition Against Kerala’s Regulations On Lotteries From Other States

The Supreme Court in the case The State of Nagaland and Ors. v. The State of Kerala and Ors., observed and has granted leave in a Special Leave Petition filed by the State of Nagaland challenging the order of Kerala High Court, wherein the court upheld the power of the State Government to regulate lotteries from other states. The bench comprising of Justice Hrishikesh Roy and Justice Prashant Kumar Mishra in the case observed and has granted leave.

The court observed during the hearing that the said matter would eventually have to go to the Hearing List.
The bench headed by Justice Roy remarked that for the similar matters, the said court have to go into…there is a whole gamut of things.

Therefore, on the petitioners’ counsel apprising the court that Solicitor General Tushar Mehta, who had been appearing for Nagaland, was on his legs before the Constitution Bench, thus, an accommodation was granted. The court observed that the petition moved assails a judgement dated 17.05.2021 of the Kerala High Court, wherein the court upheld amendments brought to Kerala Paper Lotteries (Regulation) Rules in 2018 (Rules) to regulate marketing and sale of lotteries organized by other States in their own State. The court in the case observed and has issued notice in 2022. Thus, a gist of earlier proceedings can be accessed here. The counsel, Advocates Rishi Agrawala, Parminder Singh, S.
