The Supreme Court in the case Mohammad Nawab Mohammad Islam Malik @ Nawab Malik V The Directorate Of Enforcement observed and has the interim bail granted to former Maharashtra Minister and NCP MLA Nawab Malik on medical grounds in a money laundering case by three months.

The Supreme Court in the case observed and has granted him interim bail on medical grounds for two months after being behind bars since February 2022. The Division bench comprising of Justice Bela M. Trivedi and Justice Dipankar Datta observed and has granted extension of the interim bail on the submission of Malik’s Counsel that his condition had not improved since the previous order.

The counsel appearing before the court read out excerpts from Malik’s latest reports informing the court of his kidney ailment. On the other hand, the counsel, Additional Solicitor General SV Raju appearing for the Enforcement Directorate did not dispute Malik’s condition.

The Apex Court in the case stated that the appellant at present is in Criti Care Asia Hospital at Mumbai being treated for ailments which relates to kidney and other ailments. Thus, let him be released on interim bail on medical ground for two months from today on such terms the Trial Court may consider fit and proper. The Apex Court granted him an interim bail on August 11.

Facts of the Case:
In the said case, the Enforcement Directorate arrested Nawab Malik on February 23 of last year in connection with a money laundering case allegedly linked to fugitive underworld don Dawood Ibrahim and his aides. It being the case of ED that Malik connived with D-gang members i.e., Ibrahim’s sister Haseena Parker (late), Ibrahim’s sister her driver Salim Patel (late) and Sardar Khan (1993 bomb blast convict), and usurped one Munira Plumber’s 3-acre ancestral property in Mumbai’s Kurla for a pittance despite the ready reckoner rate of the property being Rs 3.54 crore between 2003-2005.

It has also been alleged before the court that since Parkar handled the illegal business of the notorious gangster and global terrorist, the money that Malik allegedly paid her, was ultimately used for terror funding, slapping charges under the Prevention of Money Laundering Act on the former legislator.

Last Year, Malik approached the Bombay High Court, after the special court refused to grant him bail in November. Thus, Malik has been in custody at a private hospital in order to ensure continuous medical supervision. The court while considering the facts and circumstances of the case stated that this court is passing the said order which is strictly on the basis of medical condition of the appellant and this court have not entered into the merit of the appellant’s case
