The Supreme Court in the case Central Bureau of Investigation v. DK Shivakumar observed and has issued the notice in the petition moved by the Central Bureau of Investigation, CBI wherein challenging the decision of the Karnataka High Court’s to stay an investigation against Deputy Chief Minister DK Shivakumar in a disproportionate assets case.
The court in the case observed and has refused to ex-parte stay the impugned order despite the central agency’s fervent appeals.
The bench comprising of Justice Aniruddha Bose and Justice Bela M Trivedi in the case was hearing a special leave petition filed by the CBI against the order of Karnataka High Court dated June 2023, wherein the court temporarily stayed the sanction granted by the state government to investigate the Congress leader’s role in a corruption case arising out of allegations regarding disproportionate assets.
The counsel, Additional Solicitor-General SV Raju informed the bench that after the conclusion of almost 90 percent of the CBI investigation, a stay order was issued by the high court “on the basis of a false statement made in an affidavit.
The bench headed by Justice Bose-led in the case observed seeking the responses of the deputy chief minister and other respondents. Therefore, the court in the case observed and has refused to stay the high court order that has been challenged.
Accordingly, the court listed the matter for further consideration on November 07, 2023.
