Rajasthan HC scraps Munesh Gurjar’s suspension order

The Rajasthan High Court has cancelled the state government’s order to suspend Heritage Nagar Municipal Mayor Munesh Gurjar on September 22, considering it invalid. The court has also cancelled the preliminary investigation conducted in the case and has directed a re-examination within one month. Justice Anoop Kumar’s single bench accepted Munesh Gurjar’s petition while keeping the decision on the petition safe after hearing arguments from both sides in the case on November 28.

Arrested Red-Handed Taking Bribe
It is worth noting that on August 4, the ACB arrested Sushil Gurjar, the husband of Jaipur Heritage Nagar Municipal Mayor Munesh Gurjar, for taking bribes. After that, the government suspended Mayor Munesh Gurjar.

On August 4, 2023, the ACB raided the residence of Mayor Munesh Gurjar in Jaipur Heritage Nagar. The team arrested the Mayor’s husband Sushil Gurjar and two middlemen. Sushil was accused of demanding a bribe of Rs 2 lakh in exchange for making a plot. During the search at the mayor’s house, Rs 40 lakh in cash was found, for which a note-counting machine had to be arranged. Along with this, Rs 8 lakh in cash was also recovered from the house of a middleman. After this, on August 5, the Department of Local Self-Government suspended Munesh Gurjar from the post of mayor. Mayor Munesh Gurjar challenged the government’s decision in the High Court.

On August 23, the court upheld the government’s suspension order. The court, while staying the suspension, said that the government cannot suspend the mayor without a preliminary investigation. The legal process adopted by the government in this suspension is entirely wrong. After getting relief from the High Court, Munesh Gurjar, along with his supporters, reached the municipal office on August 24 and resumed his responsibilities.
