Patna Court: Rahul Gandhi to appear in Court in Defamation Case Filed by RS MP Sushil Modi; Modi Surname Remark

The Bihar’s Patna district directed Congress Leader Rahul Gandhi to appear before the court on April 12 in order to record the statement of him as stated under section 313 of Code of Criminal Procedure in the case of the Defamation filed against Rahul Gandhi by Rajya Sabha MP Sushil Kumar Modi.
However, MP Modi filed a criminal complaint moved by Senior Advocate and former Add. Solicitor General of India SD Sanjay in 2019 against Rahul Gandhi under Section 500 (Defamation) of the Indian Penal Code, 1860 over his alleged remark, why all thieves share the Modi surname, the statement made during a political campaign in April 2019 in Karol. It being the case of him that it was a derogatory remark targeting people having the ‘Modi’ surname.
Further, Rahul Gandhi obtained bail in the case in the year 2019.
The court noted that on March 23, 2023, the court in surat in Gujarat convicted Gandhi in a similar defamation case which is filed against Gandhi over this very statement, following which, Rahul Gandhi was disqualified as an MP of the Lok Sabha.
Therefore, several witnesses have already appeared in the court, on behalf of Sushil Modi and the court recorded their statements which includes the then
road construction minister in Bihar Government Nitin Nabin, the president of BJYM Bihar Manish Kumar, Senior advocate SD Sanjay, Senior Advocate Subodh Jha, Advocate Arjun Kumar, and Advocate Ratnesh Kumar.Accordingly, the court directed Gandhi to appear in person before the Court to record his statements.
