The Delhi Police on Tuesday opposed the bail plea of accused Neelam Azad in the Parliament Security Breach case before the Patiala House Court, stating that the material, evidence, and other documentary evidence indicate her complicity in the offence and thus, disentitle her to be released on bail.
The Delhi Police argued that there are reasonable grounds against the accused person, negating the possibility of bail, especially considering the ongoing investigation.
Highlighting the accused persons’ perceived power and influence, the Delhi Police argued that their release on bail could be detrimental to the investigating agency. The nature and gravity of the offense, as well as the severity of punishment, were also emphasized as relevant considerations at this stage of bail consideration.
Advocate Akhand Pratap Singh represented the Delhi Police, while Advocate Suresh Chaudhary appeared for the accused Neelam Azad. Azad had recently moved a bail plea, citing the violation of Article 22 due to not being produced before the court within 24 hours of arrest. After concluding the arguments, Additional Sessions Judge Dr. Hardeep Kaur reserved the order and scheduled the matter for January 18, 2024, for the pronouncement of the order.
The case involves a security breach at the Parliament on December 13, 2023, the anniversary of the Parliament attack case. Neelam Azad, along with other accused, was arrested on that day.
The Delhi High Court recently dismissed a habeas corpus plea filed by Azad, seeking immediate release from the custody of Delhi Police.
The breach occurred when two individuals jumped into the Lok Sabha chamber, setting off smoke cans and raising slogans during Zero Hour. Further investigation revealed that the accused had specially ordered two pairs of shoes in Lucknow, anticipating that visitors’ shoes would not be checked, allowing them to conceal smoke cans.
