In an exclusive interview with The Daily Guardian, Vikas Singh, lawyer of actor Sushant’s father K.K. Singh, said that the Supreme Court’s decision to transfer the actor’s suicide case to the Central Bureau of Investigation (CBI) would help them to get justice soon. Excerpts:

Q: How do you see this judgement and what will you say to Mumbai Police which says that they have not been stopped by the court from further investigations?

A: First of all, I thank the Supreme Court for the justice and I hope that we should get justice very soon. It appears that Mumbai police doesn’t know CrPC and have no idea about the SC judgement. Without an FIR you cannot investigate and they don’t have the power to do so. Even if an FIR is registered then according to the SC verdict, the case would go to CBI now. They will have to hand over all the materials related to the case to CBI now. And they don’t have any further jurisdiction in this case.

 Q: What is the role of Mumbai Police now in your opinion?

A: Whatever investigation Mumbai Police has done is now of no use and they don’t have any role further. If the CBI still wants to use details given by Mumbai police, they can use it for reference purposes only. CBI will start from the beginning since there is no FIR in Mumbai as it was registered in Patna. If the central agency wants, then it can rely on Bihar police’s investigation because they have recorded statements under Section 161 of CrPC and CBI can use that for limited purposes. All those people who were at home on that day will be very crucial for investigation and will be questioned first.

Q: Since the witnesses are very important in this case, have you asked for protection of witnesses or will you appeal in future?

A:This has not been raised by anyone so far in the courts. But if someone feels so, he or she can either inform the CBI or me, and if required, we will take steps in this regard to approach any court.

 Q: Enforcement Directorate (ED) and CBI both are probing the matter, do you feel that there will be a good coordination between both the agencies?

A: Both agencies will investigate from different angles. Central agencies always have a synergy between them and share information with each other which ultimately helps a lot. Many things which ED has unearthed will surely help CBI if they get it and vice versa. ED works on money laundering angle and CBI on other angles and if both work together in this case, it will benefit immensely.
