The Supreme Court on Friday refused to entertain a petition by former Mumbai Police Commissioner Param Bir Singh seeking transfer of all inquiries against him to an independent agency outside Maharashtra. “It is commonly said, the person living in a glass house shouldn’t throw stones at others,” the Court said.

During the hearing, the Supreme Court told Param Bir Singh, “You have been in the police force for 30 years. You can’t now say you want your inquiries outside the state. You can’t have doubts over in your own force.

After the top court observed that it will pass an order dismissing the petition, Singh’s counsel said he would withdraw the plea and avail another appropriate remedy.

The Supreme Court was hearing a petition filed by ex-Mumbai Police Commissioner Param Bir Singh who had challenged the departmental inquiries initiated against him by the Maharashtra Government.

The petitioner stated that the baseless and revengeful allegations made against him are aimed at silencing him and compelling him to withdraw his allegations against the then Home Minister, militate against the discharge of duties and obligations for which oath is administered by the petitioner and for which he is bound by the Constitution of India.

The multiple inquiries and investigations now being initiated against the petitioner and being given wide media publicity is not only to harass and threaten him but also to threaten all other witnesses in the CBI investigations, the plea said.

The petitioner further said that to ensure a free and fair CBI investigation in the various corrupt malpractices of Anil Deshmukh, the erstwhile Home Minister of Government of Maharashtra, it is imperative that all the allegations made by the State of Maharashtra against the petitioner ought to be investigated by the CBI itself or any other independent national investigation agency.

Prima facie none of the allegations against the petitioner have any substance in the eyes of law, the plea added.
