A petition which was filed by Ramakrishan, President of Parents Teachers Association (PTA) seeking implementation of the 7.5% of horizontal reservation for the students who clear NEET exams from Government Schools in this academic year itself, came up for hearing on Friday before the bench comprising Justices Kirubakaran and Pugazhenthi.
AG Vijay Narayanan informed the bench that the ordinance passed by the government is still pending before the Governor Banwarilal Purohit and he has not taken any decision on the ordinance so far. He also informed that the HC cannot order or set a time frame for the Governor to take any decision on any matter.
Justice Kirubakaran intervened and raised several questions over the delay by the Governor’s office. Justice Kirubakaran observed these decisions should be taken by keeping the future of the students in mind and asked wouldn’t a month is enough to decide on this matter.
Justice also questioned why there is a delay in approving the ordinance which was moved in the assembly after accepting the recommendations given by an expert committee. Justice Kirubakaran stated that government students not coming forward to apply for the NEET exam itself an indication of the mental trauma they undergo and also added that most of the government school students are not in a position to spend 4-5 lakhs on the NEET coaching classes and that this reservation will help the government school students immensely.
While explaining about the problems faced by government students who come from rural areas and try medical education, he broke down.
AG Vijay Narayana submitted before the court that the date or any announcement regarding the medical education counselling will not be announced in the State until Governor announces his decision. The case has been adjourned for 29th Oct.
Tamil Nadu Government passed an ordinance granting a 7.5% horizontal reservation for the students who clear NEET exams through government schools to help government school students secure seats in Tamil Nadu medical colleges. Though the ordinance was sent to Governor Banwarilal Purohit for his consent in June, he is yet to give his consent.
