In order to reduce the burden of cases on the Bombay High Court, soon the suits which are valued up to Rs. 10 crores will be heard by the Bombay City Civil Court.
There being the jump in the current pecuniary jurisdiction to handle cases which are up to Rs. 1 crore. An amendment is passed by the Maharashtra Legislative Council to the Bombay City Civil Court Act, 1948 to try and in order to dispose of the suits and the proceeding which are of civil nature within the Greater Mumbai valued below Rs. 10 crores.
Earlier, the bill was passed by the Maharashtra Legislative Assembly. Thus, the file being under the process in the office of the Governor.
Therefore, it being only in 2022 that the pecuniary jurisdiction of the Bombay City Civil Court was increased to an amount of Rs. 1 crore.
It has also been stated by the Deputy Chief Minister Devendra Fadnavis in the statements and the objects of the bill that over the period of more than ten years, the value of properties in Mumbai has escalated sharply. Due to sharp escalation in the value of properties, the valuation of civil suits which relates to the to properties in Mumbai have also been increased, thus, resulting in filing of more number of suits in the High Court instead of the Bombay City Civil Court.
Further, the said amendment resulted in the transfer of over 8,672 civil suits which are pending before the Bombay High Court, to the Bombay City Civil court. The notification is issued in the official gazette which will be published in due course, wherein amending Section 3 of the said Act.
