The Madras High Court in the case observed and has stated that the state authorities which includes the home department, transport department and police are bound in order to ensure that stickers and artifacts having the ‘Emblem’, G, Govt of India, the Government of Tamil Nadu, High Court, Police are not used on the private vehicles.
The bench comprising of Chief Justice SV Gangapurwala and Justice PD Audikesavalu in the case observed that while monitoring and survey of such vehicles is the continuous process. Thus, the respondent authorities are being bound to ensure that the stickers and artifacts containing ‘Emblem’, G, Govt of India, the Government of Tamil Nadu, High Court, Police and such other institutions are not misused and upon the direction of the same, the action is required to be taken up by the authorities. In the present case, the court was hearing the plea moved seeking directions to the authorities to remove such stickers from private vehicles and to take necessary actions. The court in the case noted that the single judge of the High Court in 2022 had directed the authorities in order to issue appropriate circulars to remove all kinds of unauthorised usage of flags, emblems, names, symbols etc.
