Law Commission Of India Decided Again To Solicit Views Of Public And Religious Organizations: Uniform Civil Code

It has been decided by the 22nd Law Commission of India again to solicit views and the ideas of the public at large and recognized religious organizations about the Uniform Civil Code. Therefore, the same being in view of the fact the consultation paper issued by the previous Law Commission on the subject is more than three years old.
The Law Commission of India released a Consultation Paper on ‘Reform of Family Law’ in the year 2018, wherein it is opined that the formulation of a Uniform Civil Code, UCC is neither necessary and is nor desirable at this stage.
However, the said consultation paper is now being more than three years old, thus, the present Law Commission headed by former Karnataka High Court Chief Justice Ritu Raj Awasthi has decided for inviting the views and the suggestions of stakeholders afresh.
It has also been stated by the Law Commission in the public notice which is issued that initially the 21st Law Commission of India had examined the subject on Uniform Civil Code, UCC and solicited the views of all the stakeholders which is through its appeal along with a questionnaire dated 07.10.2016 and further public appeals or the notice which are issued dated 19.03.2018, 27.03.2018 and 10.4.2018. Pursuant to the same, the Law Commissioner received the overwhelming responses. Therefore, the 21st Law Commission has issued the consultation paper on the ‘Reforms of Family Law’ on 31.08.2018 and since more than three years have been lapsed from the date of issuance of the said Consultation Paper, while bearing in mind the relevance and also the importance of the subject and the orders passed by various Court on the subject and the 22nd Law Commission of India considered it expedient to deliberate afresh over the subject.
It has also been decided by the 22nd Law Commission of India to again solicit views and the ideas of the public at large and has recognized religious organizations about the Uniform Civil Code, UCC.
The Law Commission stated that those who are interested and willing may present their views within a period of 30 days from the date of Notice through ‘click here’ button or email at membersecretary-lci@gov.in to the Law Commission of India. Therefore, the concerned stakeholders are also at liberty to make their submissions in the form of consultation, discussion, working papers on any of the issues pertaining to the Uniform Civil Code to the ‘Member Secretary, Law Commission of India, 4th Floor, Lok Nayak Bhawan, Khan Market, New Delhi– 110 003. And if there is any need, the commission may call upon any individual or organization for a personal hearing or discussion.
