The Chief Justice of Jammu And Kashmir and Ladakh High Court Justice N. Kotishwar Singh in the case SAVE through its Chairperson Vs State & Ors observed and has personally visit and will inspect the Gaushala at a village in Nargota, following reports of apparently pathetic conditions therein.
The Division bench comprising of Justice Puneet Gupta stated that the said bench will visit the Gaushala situated at Village Seri Khurd, Nagrota on 02.06.2023. Therefore, it has also been asked by the Commissioner of the Jammu Municipal Corporation, JMC and the Director of Animal Husbandry Jammu, and the Municipal Veterinary Officer of the JMC to be present during the Chief Justice’s visit to the cattle pond or Goushala. Therefore, the advocate representing both the side of the petitioner Chairperson SAVE, and Devinder Kour Madaan alias Rimpy Madaan in order to remain present during the visit.
In the present case, the court was hearing the PIL moved highlighting the dilapidated condition of a cattle pond or the Goushala at Village Seri Khurd (Nagrota). Further, the court stated that it would take first hand account of the allegations levelled in the petition.
It has also been submitted by the counsel appearing for the petitioner that it ahs been conducted by them a surprise visit to the cattle pond on April 8, 2023 and during their visit, thus, it has been witnessed by them the dilapidated condition of the Goushala, where the animals were locked inside sheds even during daylight hours, without it is being allowed to graze freely.
Further, it has also been informed by the Advocate SS Ahmed appearing that the entire surprise visit was video-graphed and the counsel requested the Division Bench in order to watch the video in open court to understand the deplorable condition of the cattle in the Goushala.
Therefore, the bench in the case then watched the video in open court which depicted the sorry state of affairs at the Goushala, wherein the court in the case granted the video in open court which depicted the sorry state of affairs at the Goushala. The counsel, Advocates, Mr. S.S Petitioner Ahmed, Advocate Ms. Supriya Chouhan, Mr. Zulkernain Chowdhary appeared for the petitioner.
