The Gujarat High Court in the case observed and has came down heavily on the state government over its failure in order to fill up the vacant posts of the members of the Gujarat Real Estate Regulatory Authority and Chairperson and technical members of the GujRERA Appellate Tribunal.
The bench comprising of Chief Justice and the Justice Aniruddha P. Mayee in the case observed wherein the Public Interest Litigation, PIL is moved by the Advocate Nipun Singhvi seeking directions to fill up the posts of members in the GujRERA which have been vacant for a considerable time now.
Therefore, the present matter has been tagged with the petitions concerning the issue of vacancies of Chairperson and technical members in the GujRERA Appellate Tribunal.
However, when it has been informed by the Government to the bench that it had already appointed the chairperson in the GujRERA, thus, the High Court inquired about the process for the appointment of other members.
Adding to it, it has been informed by the counsel appear8ing for the State government that he needed the to comply with the order of the Court of August 10, 2023 to make appointments. Therefore, the Bench asked him to place before it the process of appointments.
Accordingly, the court listed the matter for further consideration on August 28, 2023.
The counsel, Senior Advocate Percy Kavina assisted by Advocates Hiral Mehta and Vishal Dave appeared for the petitioners.
