The Gujarat High Court in the case Azajkhan Hamidkhan Pathan v. The State of Gujarat & Anr observed wherein a public interest litigation was moved seeking strict security arrangements during the religious processions to prevent any incident of violence in the State, which being ahead of the upcoming festivals of Eid and Parshuram Jayanti on 22.04.2023.
In the said case, the PIL has been moved by the court by Azajkhan Hamidkhan Pathan, the 36-year-old social worker wherein it is alleged that on the part of Gujrat Government as well as the Gujarat Police for not providing of the appropriate security at the time of religious procession during the festivals and also at the time of public rally.
The court observed in the plea filed moved that the social fabric of the country being under the threat of rupture and the same is because of the increasing incidents of mob violence and for the recurring patterns of frenzied mobs, which is being instigated by intolerance, misinformation by the fake news and by the hate speeches which are delivered by vested interested groups.
The petitioner in the plea stated that there has been litany of spiralling mob violence and the same is because of lack of proper security arrangement and for the necessary intelligence report which leads to this incidents which go unrecorded and the hate element behind them also remains unaddressed. The plea prayed for quashing the alleged inaction of the Gujarat Government and the Director General of Gujarat Police for not carrying out the videography of the public event and for the religious processions during festivals.
Further, it has also been stated in the plea moved that in the year 2021 and 2022, there have been various incidents of communal violence at different places in the State and that the said authorities have failed to prevent the same due to lack of information or input from the said resources
