The Gujarat government in the case Suo Motu v. State of Gujarat observed and has informed the High Court that the 1.3 percent the total post in the Police Department are being vacant and an appropriate step is to be taken by the court in order to fill the same.
The Division bench comprising of Acting Chief Justice A. J. Desai and Justice Biren Vaishnav in the case observed wherein a a Suo Motu Public Interest Litigation, PIL was initiated as the directions issued by the Supreme Court vide order dated 11.03.2019 in the case Manish Kumar v. Union of India and Ors, wherein the court directed the State to look into the certain aspects in connection with the Police Department throughout the country.
In the said case, it has also been directed by the High Court vide order dated 09.02.2023, wherein the court directed that State for filing affidavits with regard to the directions issued by the Supreme Court in the case Manish Kumar (supra) including the following:
Disclosing of the vacant position in Police Department in the State.
The details pertaining to constitute Police Commission to deal with allegations of police action, the redressal of grievances of police and in order to make recommendations for the welfare of police force.
Therefore, the details pertain to formulation of guidelines for prevention and control of violent mass agitations and destruction of life and property, in terms of the guidelines which are suggested by the Supreme Court In Re: Destruction of Public and Private Properties v. State of A.P. and Ors.
It has also been informed by the State Government that is has already issued guidelines to suggest the measures to prevent the damage to public and private property.
Further, the court directed the State Authorities to circulate the guidelines so that the public at large would be put to notice about the same.
Accordingly, the court listed the matter to be next heard on August 21 for further consideration.
