The Gujarat Court in the Gir Somnath District in the case observed and has granted bail to the right-wing activist Kajal Hindusthani days after she was being arrested by the Gujarat Police, wherein while following her surrender in connection with the Hate Speech case. Therefore, the speech of her on the occasion of Ram Navami allegedly caused a communal clash in Una on April 1, 2023.
It has also been ordered by the Additional sessions judge R M Asodiya that her release on the bail bond for an amount of Rs 50,000 and on the further condition that Kajal would also appear before the police twice a month and she also would not leave India, wherein the court stated to surrender her passport, etc.
Therefore, the court observed that after her arrest, she was produced before a court in Una, wherein the court sent her to 14-day judicial custody as the Gujarat Police did not seek her police remand.
In the present case, the FIR was lodged by the Gujarat Police on April 2, 2023 under section 153 (wantonly giving provocation with an intent to cause riot) and section 295 A (deliberate or malicious act with an intent to outrage religious feelings) of Indian Penal Code, 1860.
In the said she is also being accused of delivering a provocative speech targeting the people of the Muslim Community speech in a Vishwa Hindu Parishad, VHP in Una in the month of March, 20, 2023 which was being witnessed by local BJP MLA KC Rathod.
The court observed that the communal clash took place while following the event, wherein it is alleged that stone pelting also took place at various places.
Further, the FIR was lodged against Kajal, wherein it is alleged that Kajal hurt the religious sentiments of women and men of the Muslim society and that her speech was being delivered in Ram Navami was with the purpose of spreading intentional agitation to be taken place between the Hindu people and the Muslim people.
Therefore, Kajal who identifies herself as an entrepreneur, debater, research analyst, social activist, and the nationalist and is being known for her fiery speeches.
