The Supreme Court on Tuesday did not grant interim bail to Chief Minister of Delhi Arvind Kejriwal in Delhi’s excise policy case.

While hearing the case, the Supreme Court has made some pertinent points while deferring the interim bail plea order.

As per supreme court, it opined that without elections going on right now, there would be no consideration to his interim bail plea.

Further the court also expressed their concerns over the potential “cascading effects”. And said that if Kejriwal is to be given interim bail, is allowed to participate in elections and perform his official duties, how he’ll perform tasks like signing files and attending office.

The apex court further emphasized that being an elected chief minister of Delhi during elections constitutes extraordinary circumstances. However, politicians with criminal cases, shouldn’t be treated differently. But the court clarified that Kejriwal is not a “habitual offender”.

Later, the top court said that they aren’t basing their decisions whether an Indvidual is a politician or not. They reiterated that every individual has exceptional circumstances which warrants consideration.

But they also clarified that the discussion largely around whether a grant of exceptions is necessary in the light of elections or not.

However, the supreme court has now pushed forward its verdict on the interim plea on Thursday or next week without specifying the date.
