Delhi High Court To Delhi Govt: Ensure Availability Of Cloud Storage Service To Sub-Registrars For Preservation Of Documents

The Delhi High Court in the case Monk Estates Private Limited And Anr. v. Government of NCT of Delhi And Ors and has directed the Delhi Government for ensuring the availability of the Delhi Online Registration System, DORIS, the cloud storage server, to all the Sub-Registrars for preservation of documents which includes those which are related to land records.
The bench headed by Justice Prathiba M Singh in the case observed and has directed for the said purpose the Principal Secretary, Revenue, GNCTD shall be personally responsible to ensure implementation of the DORIS system.
In the present case, the court was hearing the plea moved by Monk Estates Private Limited which relates to the large quantum of records which had been gone missing from the office of a Sub-Registrar, way back in the year 2005.
The petition filed in the case seek an enquiry into the missing records which relates to the entity’s land and also to re- construct the same.
Therefore, an affidavit was filed by Delhi Government’s Principal Secretary, Revenue, which being pursuant to an order passed on March 27. The bench headed by Justice Prathiba M Singh in the case observed that while the response showed that a system has been designed for the storage of records via DORIS system, thus, it being not clear as to whether the same is to be implemented fully. Further, the court stated that GNCTD is directed to ensure that the necessary systems and cloud service is being made available to all the Sub-Registrars’ offices so that the documents can be preserved without a situation as arose in the present case which needs to be reported.
It has also been directed by the Revenue Secretary to call for a periodic status report on the investigation which is conducted with regards to the FIR registered in relation to missing land records of the entity.
It has also been stated by the said court that the FIR in the case needs to be registered and the steps needs to be taken within the period of three months. Therefore, the Officials responsible shall also be identified and action shall be taken and the Secretary, Revenue shall be personally responsible for giving effect to these directions
Accordingly, the court disposed of the plea.
