The Delhi High Court in the case KD v. VS observed and has sentences the son of business Tycoon’s to three months in prison for failing to pay maintenance to a woman, who in the case alleged that he performed a sham marriage ceremony with her, which being despite of the judicial order while recording his undertaking to pay the same.
The Division bench comprising of Justice Suresh Kumar and Justice Neena Bansal Krishna in the case observed and has imposed the fine for an amount of 2000 on the man and directed the SHO of Tilak Marg Police Station for issuing warrants of arrest against him.
The bench in the case observed and has stated in its order to Look Out Circular which is being issued against the man after it has been submitted by his counsel that he was not in India and will not be able to appear before the court.
The court in order dated 06.06.2023 stated while observing the submissions made by the counsel appearing for the respondent that it being evident that he is not willing to purge the contempt by complying with the orders or to address on the sentence. The said court in the case sentence him for Simple Imprisonment of three months wherein imposing the fine for an amount of Rs. 2,000/-. Therefore, the court also directed the SHO, Tilak Marg for issuing the warrants of arrest against the respondent and shall also get the Look Out circular issued against the respondent.
In the present case, the pela is moved by woman wherein it is alleged that the contempt of court by the man for failing to comply with an order passed by a coordinate bench on June 01, 2023.
The court in the case observed and has also recorded that the undertaking of him shall continue to pay the maintenance amount as he has been doing in the past, which being on or before the 7th day of each English calendar month.
Further, the woman alleged before the court that the man is habitual in his disrespect and disdain for the law and has deliberately violated various judicial orders, which includes those passed with his consent, undertakings, and the assurance.
However, the court observed that the parties are involved in multiple proceedings, which includes visitation rights of their four-year-old minor child and a criminal case filed by the woman alleging that he has raped her on the false pretext of marrying her.
The Trial Court in the case directed the Delhi Police for registering an FIR against the man after a case was filed by the woman. Thus, the High Court stayed the order of the High Court after the man challenged the same.
Accordingly, the court listed the matter for further consideration on July 19, 2023.
