The Delhi High Court in the case Communication Components Antena Inc v. Rosenberger Hochfrequenztechnik Gmbh And Co. KG And Ors observed and has recently recorded evidence by way of live transcription while hearing a patent infringement suit.
The bench of Justice Prathiba M Singh in the case observed and has concluded the cross-examination of two plaintiff witnesses and two defendant witnesses using live transcription with the consent of the parties in open court. Thus, the transcription agency engaged was Opus 2 Limited.
In the present case, the suit was filed by Communication Components Antena Inc wherein it alleged infringement of its patent titled ‘Asymmetrical Beams for Spectrum Efficiency’ by Rosenberger, a company which manufactures and sells high-voltage and fiber optic technologies.
It being the case of plaintiff that its patent was related to a method and apparatus enabling the increase in subscriber capacity and enhancing performance of a base station. It was also alleged before the court that Rosenberger was found to be selling telecom antennas, thereby infringing the suit patent.
The court in the case observed that the cross-examination of two plaintiff witnesses who were the President of Communication Components Inc. and the Managing Director of M.S.C. Wireless Ltd. Both of them joined the proceedings of the court virtually. The court stated that the transcription agency shall e-mail the final version of the transcription as also the audio recording for the cross examination to the Court Master.
The bench of Justice Singh in the case observed and has concluded that the cross examination of two defendant witnesses and appreciated both the sides as well as the witnesses for adhering to the fixed schedule.
Therefore, the said courts record the appreciation of both the counsels as also respective witnesses for broadly adhering to the schedule fixed by the Court. Therefore, over the period of two days i.e., on September 20, 2023 and September 22, 2023, thus, the Plaintiff’s and the Defendant’s evidence is concluded, after recording the cross examination of four witnesses – two technical witnesses and two fact or in-house witnesses, from each side. The bench of Justice Singh in the case observed and has directed the transcription agency to e-mail the final version of the transcription and the audio recording for cross examination to the court master as well as to lawyers of both the parties.
Accordingly, the court listed the matter for further consideration on January 09, 2023. The counsel, Senior Advocate Gaurav Pachnanda, with Advocates Sidhant Goel, Mohit Goel, Aditya Goel, Deepankar Mishra and Avni Sharma appeared for the plaintiff.
The counsel, Senior Advocate Sandeep Sethi, with Advocates Varun Sharma, Manish Aryan, Manisha Singh, Abhai Pandey, Swati Mittal, Gautam Kumar, Shreya Sethi, Priyanka Anand, Ria Kumar, Priyanka Anand, Shivani Singh and Dhruv Tandan represented the defendants.
