The Delhi High Court in the case Dr. Aniruddha Narayan Malpani v. The Union of India And Anr. observed and has issued notice on a public interest litigation moved wherein it challenged the appointment of Dr. Nitiz Murdia, the Embryologist as an expert member of the National Assisted Reproductive Technology and Surrogacy Board.
The Division bench comprising of Chief Justice Satish Chandra Sharma and Justice Saurabh Banerjee in the case observed and seek responses of the Union Ministry of Health and Family Welfare and Murdia whose appointment was being notified in August last year.
The present PIL was moved by Dr. Aniruddha Narayan Malpani, the reproductive healthcare professional, who in the case has alleged that there being no proof that Murdia holds requisite qualification of at least 15 years as an ‘Embryologist’ which in the case is required to be an expert member of the Board.
Therefore, an RTI has been filed by Malpani wherein seeking information with regards to the appointment of Murdia’s. Thus, the reply to the RTI application stated in the case that Murdia holds a Ph.D. from California Public University in ‘Embryology, IVF Health and Business’ and possesses 17 years of experience as the Chief Embryologist.
However, an appeal was moved by Malplani wherein seeking copies of Murdia›s Embryology degree and the appointment letter.
The court received no reply on the said case.
The court observed that Malplani in the case also seek copies of Murdia›s embryology degree and appointment letter, to understand the basis of his appointment as an expert in the Board.
The plea stated that the Respondent no. 2, Murdia has on the basis of false and misleading information obtained the appointment, wherein it is clearly indicated that that he has usurped a public office without possessing the requisite qualifications and training required under the Surrogacy, the Regulation Act, 2021 and the Assisted Reproductive Technologies Act, 2021 and the Rules made thereunder.
