Delhi High Court: AIADMK moves Seeking Direction For Updation Of Its Amended By-Laws With EleCtion commission of India

The All India Anna Dravida Munnetra Kazhagam, AIADMK and Thiru K Palaniswamy, though its interim General Secretary in the case All India Anna Dravida Munnetra Kazhagam and Anr. v. Election Commission of India observed and has moved Delhi High Court wherein seeking directions for updation of its records with the Election Commission of India.
The bench headed by Justice Prathiba M Singh in the case observed before whom the case was listed and has recused from hearing the same.
In the case, AIADMK seeks direction for ECI to for considering its representations and to upload the latest amended bye-laws dated 11.07.2022 in the said record.
The court was also appraised that an application has been filed by former Chief Minister of Tamil Nadu O. Panneerselvan seeking intervention in the said matter.
The court observed in the case of AIADMK that the ECI has acted contrary to the settled legal principles by taking a stand that the amended bye-laws are not being updated owing to certain internal disputes pending between the parties.
The plea in the case was moved in wake of the announcement of the schedule for elections in Karnataka. The court stated that the last date of filing of the nomination is April 20, 2023.
It has been stated in the plea of AIADMK that the inaction of the ECI to upload the latest bylaws on the websites will serious impact on its democratic fabric as a recognised political party having significant presence in Kamataka as it will be unable for participating in the elections.
Further, it has been submitted that the ECI’s inaction for uploading the amended records will lead to a situation where AIADMK will not be able to put up a candidate or carry out any other administrative function.
The petition added that the inaction of ECI is causing grave prejudice and hardship not only to the AIADMK Party but also to the primary members of AIADMK Party and the entire citizenry of State of Tamil Nadu for the reason that absolute strangers to the AIADMK Party are representing themselves as Coordinators and other office bearers of the Party.
