The petition of challenging the appointment of an Alderman by the LG in the Delhi MCD has been filed by the Delhi Government. The Supreme Court will hear the matter in detail tomorrow.
Advocate Abhishek Manu Singhvi, on behalf of the Delhi government, said that for the last 30 years, the Delhi government has been appointing aldermen. LG was only in the role of advisor. This is the first time when LG has appointed Alderman which is against the rule.
Delhi government’s lawyer Abhishek Manu Singhvi said that a note is issued on January 2, 2023, which is signed by the Ministry of Corporation and he directly says that LG will nominate. This is the first time LG has nominated directly. The Delhi Government said that many times in the past, there have been separate governments in Delhi and the Center but even then the LG had accepted the advice of the Delhi Government.
The court asked the ASG that what are the powers of LG under which LG appointed Alderman.Does 239 AA of the GNCT Act of the Constitution give this power? On this ASG Sanjay Jain replied that this is the right comes under 243 (E) and (Q).
