The Calcutta High Court in the case observed and has imposed the fine on the State’s Criminal Investigation Department, CID to the tune for an amount of Rs 5 lakh for failing to comply with the earlier court’s order for transferring the probe which pertains to the money laundering in a co-operative society to the Central Bureau of Investigation, CBI and the Enforcement Directorate, ED.
The single bench headed by Justice Abhijit Gangopadhyay in the case observed and has refused to recall its earlier orders wherein the court directed for transfer of the probe and held that the plea filed by the CID was not only absolutely frivolous, but that it was tantamounting to playing with the court order.
The court in the case directed the CID in order to comply with the with its orders.
Further, the court observed and has imposed the cost of Rs 5 lakh on it, which is being payable September 22nd to the High Court Legal Services Authorities.
The court stated that this court does not find that there being no ground for recalling of the order and this is absolutely a frivolous application. Thus, the court direct the CBI and ED to start the investigation by three days from date if not done already and this court direct the CID to hand over all papers and documents to CBI and ED by 18.09.2023.
Accordingly, the court listed the matter for further consideration on September 18, 2023.
