Calcutta High Court, DB: Denies Interim Stay On CBI-ED Probe; Municipality Recruitment Scam

The Division bench comprising of Calcutta High Court in the case observed and has refused to issue any interim stay on the order of April 21 wherein it has been directed by the Single Judge that the Central Bureau of Investigation or the Enforcement Directorate to probe into the alleged the Municipality Recruitment Scam in the State.

The vacation bench comprising of Justice Biswajit Basu and Justice Apurba Sinha Ray was hearing the plea moved by the State Government, earlier this month the bench of Justice Amrita Sinha in the case observed and has dismissed the plea moved by the State government against its order for transferring the probe in West Bengal Municipality Recruitment Scam to CBI.

Therefore, the matter has now been posted by the vacation bench before the regular division bench of the High Court in the month of June 06, 2023.
Facts of the Case:
In the present case, the ED arrested a businessman, associated with the Trinamool Congress, TMC while probing into the West Bengal Teachers’ Recruitment Scam. Thus, the ED in the case discovered during the search that several incriminating documents which indicated that a scam had occurred in the recruitment in various municipalities, and hence, this alleged scam came to light.

The bench comprising of Justice Gangopadhyay observed and has given the liberty to the CBI and the ED to initiate a probe into the alleged scam in April 21, 2023. Further, the Supreme Court in the case directed the ED and CBI to maintain the status quo with regards to the investigation of the Municipality Recruitment Scam for a week.

It has also been noted by the Supreme Court in the case that the State of West Bengal had not been served the notice of proceedings and the court opined that in the interest of justice, thus, the State of West Bengal be heard afresh by the High Court with regards to the issue as to whether the investigation should be initiated by the CBI.
In the said case, the court was hearing the order of Justice Gangopadhyay, wherein the State Government moved a review petition before the bench of Justice Sinha and the same was to be dismissed earlier this month.
Accordingly, the court listed the matter to be next heard on June 06, 2023.
