The Bombay High Court in the case observed and has refused to stay the release of Bollywood film ‘I Love You’ in the plea move din the copyright infringement case filed by Lions Gate India LLP, LGIL against the makers of the film.
In the present case, the company complained that the LGIL alleged that that Athena E&M LLP, the producers of ‘I Love You,’ had infringed their exclusive right to remake the American film ‘P2’. American company, Summit Entertainment had the exclusive copyrights of P2 and also its Hindi remake rights were given to LGIL.
Therefore, LGIL in the case seek an injunction against Athena and Viacom 18 Media Pvt Ltd, as the said film is said to be release on Viacom’s online platform.
Further, it has also been contended by the petitioner that they have learnt about the film’s release only on June 5, 2023 and has immediately approached the High Court. Thus, they also seek 10 crores in damages as final relief.
The bench headed by Justice RI Chagla while following the arguments by both the sides seek responses from the defendants on the question of grant of interim relief and posted the matter for hearing next week. However, the court refused to stay the film’s release.
The prayed was opposed vehemently both the counsels, Senior Advocate Ashish Kamath representing Viacom and advocates Ameet Naik and Madhu Gadodia from Naik Naik & Co.
Accordingly, the court listed the matter to be heard next week.
