The Bombay High Court in the case Nawab Malik v. Directorate of Enforcement observed and has refused to grant temporary bail to the former Maharashtra Cabinet Minister and NCP leader Nawab Malik in the Enforcement Directorate’s money laundering case.
The bench headed by Justice Anuja Prabhudessai passed the said order.
In the present case, the bail plea was moved by Malik wherein he seeks on the ground that one of his kidneys has failed and the other is functioning only at 60 percent capacity and the same is deteriorating further.
As per the plea moved by Malik, he had been suffering from kidney problem before the arrest of Malik in February 2022 which got aggravated after the arrest of him and it is affecting other organs as well.
Therefore, the bail application was opposed by the Enforcement Directorate wherein it is argued that many people survive with one kidney.
Further, it has been stated in the medical reports that kidney was functioning at 60% of its capacity, hence bail on medical grounds could not be invoked in the case of Malik’s.
However, It being the case of Enforcement Directorate that Malik connived with D-gang members i.e., Haseena Parker (late), the driver of her Salim Patel (late) and Sardar Khan (the 1993 bomb blast convict), and the usurped one Munira Plumber’s 3-acre ancestral property situated in Kurla for a pittance despite the ready reckoner rate of the property being amount for Rs 3.54 crore between 2003-2005.
The Enforcement Directorate in the case observed and has also arrested Malik wherein it is alleged before a special PMLA court accusing him of money laundering under section 3 and section 4 of the Prevention of Money Laundering Act. Malik is currently in judicial custody in the private hospital.
