The Bombay High Court in the case Gautam Navlakha v. National Investigation Agency observed and has issued the notice to the NIA wherein a fresh bail application in moved by senior journalist Gautam Navlakha who is being arrested in the Bhima Koregaon in the Elgar Parishad case and he is being accused of having CPI i.e., the Maoist links.
The Division bench headed by Justice AS Gadkari will hear the matter on 28.06.2023.
The court in the case observed that the trial court gave cryptic reasoning while refusing the bail plea of Navlakha’s. Thus, it has been directed by the Bombay High Court that the Special NIA Court in order to hear and decide the case afresh. Therefore, Gautam Navlakha has approached the High Court after his bail plea was re-adjudicated and the court denied his bail.
It has then stated by the said court that the trial court has not given reasoning as it is required under section 43D(5) of the UAPA while the court rejected his bail application. Thus, the reasoning stated in the order is very cryptic and there is no analysis.
Further, Navlakha is currently in the under house arrest after Supreme Court allowed his transfer from jail to house arrest on account of his medical condition on 10.11.2022, which being subject to various conditions.
However, senior journalist Gautam Navlakha, the 73-year-old human rights activist had been in custody since August 2018.
Therefore, he has been booked under Sections 153(A), 505(1)(B), 117, 120(B), 121, 121(A), 124(A) & 34 of Indian Penal Code, 1860 and Sections 13, 16, 17, 18, 18(A), 18(B), 20, 38, 39 & 40 of the Unlawful Activities, the Prevention Act, 1967.
Therefore, Gautam Navlakha in the case being accused of furthering the banned CPI the Maoist’s agenda and conspiring to overthrow the government. Therefore, the NIA in the case has also accused him of instigating the caste violence that erupted at Bhima Koregaon on 01.01.2018 the war memorial site in Pune.
It has also been alleged by the NIA before the Special Court that Navlakha was actively involved in fixing the appointments and meetings between the active urban cadres and underground leaders of CPI, the Maoist under the garb of fact-finding missions.
