The Allahabad High Court in the case Sujeet Sharma vs. State of U.P observed and has granted bail to the man (named Sujeet Sharma) who being accused of making a video abusing the Chief Minister of the state, Yogi Adityanath, and has shared the same on WhatsApp.
The bench comprising of Justice Ajay Bhanot in the case observed wherein the submissions were made by the counsel holding constitutional dignitaries in the highest regard and that he did not have any intention for insulting the high constitutional dignitaries.
Before the Court, it was also submitted that the accused was induced into drinking by the co-accused persons and may have blurted out some objectionable words being under the influence of liquor and that the video was captured and was circulated without the knowledge and consent of him.
The court directed with regards to the submissions made that the accused Sujeet Sharma be released on bail on furnishing of a personal bond and two sureties each in the like amount to the satisfaction of the court below.
Therefore, it may also be noted that the said accused had been booked under section 504, section 506, section 386 of Indian Penal Code, section 66 of Information Technology Act, and Section 3 or Section 25 of the Arms Act and was arrested in October 2022.
The court observed that as per the FIR in the case, a piece of information was being received by the Kushinagar Police personnel that a video made by Sharma abusing the Chief Minister of the State and it was getting viral on social media. Thus, the FIR was being lodged against him on 07.10.2022 and he was being arrested on 22.10.2022.
