SC refuses to stay Election Commission decision on Shiv Sena name and symbol

SC refuses to stay Election Commission decision on Shiv Sena name and symbol

The Apex Court on Wednesday refused to stay the Election Commission’s decision to allot the party’s name ‘Shiv Sena’ and the ‘Bow and Arrow’ symbol to the faction led by Maharashtra Chief Minister Eknath Shinde, saying, “we can’t stay an order at this stage”.

The Supreme Court clarified that Uddhav Thackeray led faction can pursue other remedies of law if any action is taken which is not based on the EC order. The Higher Court listed the matter after 2 weeks.

While presenting his case, the Senior Advocate, Kapil Sibal, insisted on SC to grant interim relief and said that they are taking office after office and urged the court to pass a status quo order.

Following that SC asked rival faction of Eknath Shinde to file a reply to the petition. On Tuesday, Sibal urged the court to hear the plea on Wednesday, February 22, 2023, submitting that if the EC decision is not contested and challenged then the rival faction will take over everything, including the party’s bank accounts, among other things.
