US Imposes Stricter Photo Rules to Tackle Immigration Identity Fraud

The United States Citizenship and Immigration Services has announced a major update to its photo requirements for immigration applications. The move aims to strengthen identity verification and prevent misuse of outdated images that can undermine the integrity of the system.

With the new policy now in force, applicants must follow stricter standards for submitting photographs, marking a significant shift from the leniency that existed during the pandemic years.

Why USCIS Updated Its Photo Rules

The latest directive clearly states that photographs older than three years will no longer be accepted. USCIS will rely only on pictures taken by its own staff or approved service providers, eliminating the option for applicants to upload or reuse personal photographs.

This is a sharp departure from previous practice, when images could be reused for up to a decade.

A Shift Away From Pandemic-Era Flexibility

During the COVID-19 period, USCIS relaxed its policies to reduce in-person visits, which led to some applications using biometrics captured more than 20 years ago.

Once pandemic restrictions eased, the agency tightened the window to ten years, but officials now believe even that allowance poses risks. The new three-year limit is seen as essential for keeping records current and accurate.

Strengthening Identity Verification

USCIS maintains that more rigorous image screening is an important part of protecting the immigration system against fraud. The updated rules align with the Department of Homeland Security’s broader efforts to modernize vetting procedures. The agency notes that identity checks must evolve with technological advancements and emerging security risks.

Forms That Now Require Fresh Photographs

Under the revised guidelines, several key immigration processes will always need new photographs, regardless of when an applicant last submitted one. These include:

  • Form I-90: Replacement of Permanent Resident Card
  • Form I-485: Adjustment of Status to Permanent Resident
  • Form N-400: Application for Naturalization
  • Form N-600: Certificate of Citizenship

In all cases, USCIS can request new photographs at any time if it deems the previous images insufficient.

What This Means for Applicants

The policy is now active, and applicants must prepare for stricter documentation requirements. While the change may add an extra step for many, USCIS argues it is necessary to ensure the accuracy and reliability of identity records across the immigration landscape.
