The Delhi High Court has agreed to hear Bibhav Kumar’s plea challenging his arrest in the assault case involving AAP MP Swati Maliwal on May 31. Kumar, a close aide of Delhi Chief Minister Arvind Kejriwal, filed a plea seeking the declaration of his arrest by Delhi Police as illegal, citing violations of Section 41A of the Code of Criminal Procedure.

The plea also requests appropriate compensation for the unlawful arrest and urges departmental action against officials involved in the decision-making process leading to the arrest.

The trial court recently denied bail to Bibhav Kumar, citing concerns about potential witness influence and evidence tampering, as the investigation is still in its early stages. The court noted Kumar’s presence at the CM’s house after his termination from employment and mentioned issues with accessing his mobile phone data and blank CCTV footage from the CM’s office.

During arguments, the complainant’s counsel emphasized Swati Maliwal’s status as an AAP MP and highlighted the severity of her injuries, indicating a long association with the CM’s office and alleging brutal assault by Kumar.
