The Supreme Court is scheduled to address the dispute arising from conflicting orders of a single-judge bench and a division bench in the matter of fake caste certificates in West Bengal.

Chief Justice DY Chandrachud will lead a five-judge bench, including justices Sanjiv Khanna, BR Gavai, Surya Kant, and Aniruddha Bose. The case, titled “In Re: Orders of Calcutta High Court dated January 24, 2024, and January 25 and Ancillary Issues,” centers on contradictory orders by Justice Abhijit Gangopadhyay and the division bench headed by Justice Soumen Sen.

Justice Gangopadhyay accused Justice Sen of acting on behalf of a political party in West Bengal, leading to a call for a reevaluation of the division bench’s orders.

The controversy originated from allegations of widespread issuance of fake caste certificates to facilitate admissions to medical courses. Justice Gangopadhyay, on January 24, directed the West Bengal Police to provide related documents to the CBI, a decision later stayed by the division bench.

The single-judge bench reaffirmed its stance on January 25, prompting remarks against Justice Sen. The Supreme Court will address this issue in a special sitting today.
