The hearing on the petitions challenging the caste enumeration and economic survey in the state by the state government in the Patna High Court was completed. The High Court will pass an interim order tomorrow on 4 May 2023.
A division bench of Chief Justice KV Chandran is hearing the petitions of Akhilesh Kumar and others. The court wanted to know whether it is a legal obligation to conduct census and economic survey on the basis of castes.
The court has also asked whether this right is under the jurisdiction of the state government or not, as well as whether it will violate privacy.
During the hearing, the petitioner’s advocate Dinu Kumar told the court that the state government is conducting caste and economic surveys. He told that this right to conduct the survey is beyond the jurisdiction of the state government.
He told the court that the state government is conducting caste enumeration and economic survey which is against the constitutional provisions.
He said that such survey can be conducted by the Central Government under the provisions. It comes under the power of the Central Government. He told that the State Government is spending five hundred crore rupees for this survey.
On the other hand, the state government says that this survey is being conducted to make plans for public welfare and to improve the social level.
The Court will give interim order on this matter tomorrow on 4 May 2023.
