The Delhi High Court in the case HC Gupta v. CBI and other connected matter observed and seek responses of the Central Bureau of Investigation on the appeals moved by the by former coal secretary H C Gupta and former IAS officer K S Kropha against their conviction and three years sentence in a case which relates to the irregularities in the allocation of the coal block in Chhattisgarh.
The bench headed by Special Judge granted bail to Gupta and Kropha in order to enable them to challenge their conviction before the High Court.
The bench headed by Justice Dinesh Kumar Sharma in the case observed and has issued the notice on the appeals and has stated that Gupta and Kropha will remain out on bail till the final disposal of the matter.
The court in the case observed and has stated that the same will be listed in due course along with the appeals moved by other convicts.
The court issued the notice and the notice was accepted by the counsel appearing for the CBI. Further, the appeal are admitted by the court and will come for hearing in due course.
Therefore, the said court also convicted Gupta and Kropha, the former Rajya Sabha MP Vijay Darda, his son Devender Darda and businessman Manoj Kumar Jayaswal were also being convicted in the said case. Thus, the three of them were being awarded four years of sentence by the Trial Court.
The bench headed by Justice Sharma in the case observed and has granted bail to Dardas and Jayaswal while issuing notice on their appeals against conviction and sentence.
It has also been observed by the trail court that they obtained the block by cheating the government.
Further, it has been held by the trial court that the accused persons guilty of criminal conspiracy as stated under section 120B and cheating, section 420 under the Indian Penal Code, 1860 and the other offences as stated under the Prevention of Corruption Act.
The court in the case also imposed the fine for an amount of Rs. 50 lakhs on JLD Yavatmal Energy Pvt Ltd, the entity which was also being convicted in the matter and the fine for an amount of Rs. 15 lakhs each was also being imposed by the special judge on the Dardas and Jayaswal.
The court also directed the other three convicts to pay a fine for an amount of Rs. 20,000 each.
