Kerala Court Rejects Bail Plea of Palakkad MLA Mamkootathil Amid Serious Sexual Assault Charges

A Kerala court refused anticipatory bail to Palakkad MLA Rahul Mamkootathil in a rape case, as Congress expelled him amid rising sexual assault allegations.

A Kerala court on Thursday denied anticipatory bail to Palakkad MLA Rahul Mamkootathil in a rape case registered against him. The order was issued by Thiruvananthapuram Sessions Court Judge Nazeera S, who dismissed Mamkootathil’s request for protection from arrest.

Proceedings Held In Camera of Palakkad MLA Rahul Mamkootathil Case

The hearing took place behind closed doors after both the MLA and the complainant asked for in-camera proceedings, meaning the public and media were not allowed inside the courtroom.

Congress Expels the Palakkad MLA Rahul Mamkootathil as More Allegations Surface

In a parallel development, the Congress expelled suspended Kerala MLA Rahul Mamkootathil after additional allegations of sexual assault were raised against him.

Complaint Against Palakkad MLA Rahul Mamkootathil Submitted to the Chief Minister

Mamkootathil approached the court only after the police officially registered a rape case based on a written complaint submitted by the survivor and her family to Chief Minister Pinarayi Vijayan on November 27.
The complaint accused the MLA of rape, assault that led to pregnancy, and forcing an abortion.

The survivor also alleged that Mamkootathil threatened her by recording their intimate moments on video.

Charges Under Bharatiya Nyaya Sanhita on Palakkad MLA Rahul Mamkootathil

Police booked the MLA under multiple sections of the Bharatiya Nyaya Sanhita (BNS), including:

  • Section 64 – rape

  • Section 89 – forced miscarriage

  • Section 316 – criminal breach of trust

  • Section 351 – criminal intimidation

  • Section 329 – trespass

  • Section 116 – causing grievous hurt

MLA Claims Allegations Are Fabricated

In his plea for anticipatory bail, Mamkootathil argued that the accusations are false, politically motivated, and aimed at damaging his reputation.
