Bombay High Court Directed Mumbai Civic Body: Ensured No Illegal Animal Slaughtering In Housing Society On Bakri Eid

The Bombay High Court in the case observed and has directed the Mumbai civic body, MCB in order to ensure that there being no illegal goat sacrifice on the occasion of Bakri Eid at Nathani Heights, a society at Mumbai Central.
The Division bench comprising of Justice GS Kulkarni and Justice Jitendra Jain in the case observed and has stated that in the event of the Municipal Corporation has not issued a license in order to undertake slaughtering of animals at the said place, the officers of the Municipal Corporation with the aid of the police personnel shall take appropriate action in accordance with law for preventing slaughtering of animals proposed for Bakri Eid.
In the present case, the court was hearing the plea moved by the society member of Nathani Heights named Haresh Jain, wherein the plea seek directions to authorities to take necessary action and prohibit slaughter of animals in open society.
The bench headed by Acting Chief Justice constituted a special bench to hear the matter urgently/
The Counsel, Advocate Subhash Jha appearing for the petitioner argued before the court that he sought an urgent stay on the slaughtering for Bakri Eid.
On the other hand, the counsel, Advocate Joel Carlos for the BMC submitted before the court that no such ban could be imposed and that the BMC’s policy permitted licensed goat sacrifices on the occasion of Bakri Eid at designated locations in housing complexes
It has been stated by the Carlos that an officer from BMC would be sent to check and take action if any violation was found and the word of the petitioners cannot be taken to impose ban.
Further, the court observed and has passed the direction while granting interim relief:
The Municipal Corporation shall ensure that no illegal slaughtering of animals shall be allowed at Nathani Heights, Mumbai unless the same is being recognized or licensed by the Municipal Corporation.
The Action taken by BMC and police to prevent slaughtering if license is not taken.
The Police Commissioner or the Officer-in-Charge of Nagpada Police Station is directed to provide appropriate police assistance to the officers of the Municipal Corporation in the event an action is required to be taken.
Accordingly, the court listed the matter for further consideration on July 3, 2023.
