Elon Musk's X at Risk of Lawsuit Over Negligence on Child Pornography

A federal appeals court recently reviewed a negligence claim against X (formerly Twitter) in a child exploitation case

The lawsuit involves explicit content of two minors uploaded to Twitter before Elon Musk acquired the platform in 2022

Two boys were tricked on Snapchat into sending nude images. These were compiled into a video and uploaded to Twitter

Twitter took nine days to remove the video and report it to the National Center for Missing and Exploited Children (NCMEC). By this time the video had been viewed 167,000+ times

The appeals court ruled that Twitter must face a negligence claim for the delay in their action

The court said Section 230 immunity doesn’t cover failure to report child pornography after actual knowledge

The court dismissed claims that X benefited from sex trafficking or amplified such content through search features

X will also face a claim that its infrastructure made it too difficult to report child pornography
